I understand that the novel coronavirus, or COVID-19, is an international pandemic that is currently present worldwide and in the United States. Like some other viruses, COVID-19 appears to be transmitted between people by physical contact or even close proximity. Prolonged exposure to an individual infected with COVID-19 in an enclosed setting is likely to significantly increase the chances of contracting the disease and may cause a resulting case of COVID-19 to be more severe. As a result, there are risks of transmission of COVID-19 associated with attending an in-person, SEYSA-sponsored event. These risks include, but are not limited to: exposure to, or coming into contact with, persons who have been exposed to COVID-19 and who may be contagious, including venue employees, SEYSA Members, Candidates, and other event participants. It is not possible to completely eliminate the potential for the presence or transmission of COVID-19, even with any precautionary measures that SEYSA’s event venues may take to mitigate risks. I understand that, because COVID-19 is a novel disease, the data and recommendations relating to COVID-19 are constantly being revised, and its potential or likelihood of transmission is not quantifiable.
By coming to a SEYSA event, I voluntarily assume all risks related to exposure to COVID-19.
I certify that I will not attend a SEYSA event if I have a suspected, diagnosed, or confirmed active infection with any communicable disease, including COVID-19; or if in the preceding 14 days I have tested positive for COVID-19 or am awaiting the results of a COVID-19 test, have any symptoms of COVID-19, have been exposed to COVID-19 as per the above, or am currently under quarantine or self-quarantine.
In addition, I certify that I will not attend a SEYSA event if I have had any of the following symptoms in the 72 hours preceding the event:
- Fever or chills
- Cough
- Shortness of breath or difficulty breathing
- Fatigue
- Muscle or body aches
- Headache
- New loss of taste or smell
- Sore throat
- Congestion or runny nose
- Nausea or vomiting
- Diarrhea
I understand that the SEYSA Association contracts with third-party venues for its events and will do its best to ensure that all venues follow local guidelines for health and safety measures to respond to the Covid-19 pandemic. I further understand that the SEYSA Association has no control over the administration of these venues and accepts no liability relating thereto. I understand that I should direct any questions or concerns regarding health and safety measures to the particular venue.
I have read the above, understand what I have read and am generally aware of the risks of contracting COVID-19 in connection with attending a SEYSA event. I agree on behalf of myself, my heirs, legal beneficiaries, successors and assigns, and any of our attorneys, agents, and representatives, to irrevocably and unconditionally forever release, remise and discharge SEYSA, together with its affiliates, successors and assigns, and their employees, attorneys, agents and representatives (“SEYSA Releasees”), from all charges, complaints, claims, grievances, liabilities, obligations, promises, agreements, controversies, damages, actions, causes of action, suits, rights, demands, costs, losses, debts, penalties, fees, wages, expenses (including, without limitation, attorneys’ fees and costs) and punitive damages, of any nature whatsoever, that exist now or may arise in the future, related to COVID-19 and its effects, including, for example, claims of negligence and/or that SEYSA did not do enough to protect me from the risk of COVID-19 infection (collectively, “Claims”). I absolutely, unconditionally and irrevocably, covenant and agree to release SEYSA Releasees from any claims of negligence or otherwise on behalf of myself and covenant not to commence any action against SEYSA Releasees in connection with any contraction by me of COVID-19. I hereby acknowledge and agree that this release provision is material and that SEYSA would not agree to permit me to attend a SEYSA event without it. As such, I agree to indemnify, defend at my expense (or that of my estate), and hold SEYSA Releasees harmless from and against any and all Claims related to COVID-19 and its effects.
I further acknowledge that if I am not amenable to signing this Risk Disclosure / Liability Waiver for any reason, then I am not permitted to attend a SEYSA event.
I expressly agree that this Waiver is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Massachusetts, and that this Waiver is governed by and to be construed in accordance with the laws of the Commonwealth of Massachusetts, without giving effect to its conflicts or choice of law rules. I agree that the sole and exclusive jurisdiction and venue for litigation between myself and SEYSA concerning this Waiver shall be the courts of the Commonwealth of Massachusetts or in the United States District Court for the District of Massachusetts.
